Your Honor. The State case fails to show constructive possession as a matter of the law.

The property in question that the state recovered items from was accessible by multiple individuals, alongside was subject to a recent break in. State failed to produce fingerprints, DNA , admissions, eyewitness testimony , or any forensic evidence connecting my client Myles Malone to the overwhelming majority of contraband seized. The only item directly attributable to my client was his own firearm at the time. Owning a property alone is insufficient to establish knowing possession and control over contraband. The state theory entirely relies on speculation and assumption rather than proof beyond a reasonable doubt.
At this time the defense moves to dismiss the charges for insufficient evidence.

The Court has reviewed the Defendant’s Motion to Dismiss in the matter of State v. Myles Malone.

At this time, discovery remains open and the Court finds the Motion premature. Arguments regarding evidentiary sufficiency and constructive possession are more appropriately addressed at trial following the completion of discovery.

Accordingly, the Defendant’s Motion to Dismiss is hereby DENIED without prejudice.
