STATE ARGUMENT
The State argues the defendant fled from law enforcement after being contacted for poaching. During the pursuit on Grand Ocean Highway, the defendant fired multiple shots at officers, striking Officer Lavender. Officer Raymond Green and additional officers eventually took the defendant into custody.
DEFENSE ARGUMENT
The Defense argues the State failed to prove intent required for Attempted 2nd Degree Murder of a Government Employee.
The Defense also objected to references of marijuana use due to lack of evidence and prejudice.
COURT ANALYSIS
Assistant Chief Justice Dwight Medick found the main issue in the case was intent. The Court determined the defendant intentionally fired at officers in an attempt to neutralize the threat while fleeing law enforcement.
