Wheeler wants to contest the restraining order as there are no legal grounds that constitute permanent removal of party from area outside of LSC. In the course and scope of employment as a licensed tow truck operator, Wheeler is well within his right to tow illegally parked vehicles as LSC does NOT own any property outside of the shop. Nor has Wheeler threatened, harassed, assaulted, or contacted LSC in any way other than towing outside their business in a public lot. The city also does not actively recognize loading zones as official parking spots. Towing a car and a person retaliating should not fall on the legal tow driver but the individual retaliating, yet only the tow truck driver had a restraining order put on them. Parking legally would mitigate any problems. Continuing this restraining order would prevent lawful occupation at a public location where I have every right to operate. It would reward LSC attempt to control public or third-party property that they do not own.
